Karl H. Schneider Quoted in Law360 Article “How A Showcase Prosecution Collapsed For New Jersey's AG”

Schneider, a member of Eastman & Smith’s White Collar Crime and Investigations Group, spoke with Law360 about the breakdown of a prominent corruption court case brought by New Jersey Attorney General Matthew Platkin against businessman George E. Norcross III.  It was alleged that Norcross extorted companies in the development of waterfront property located in Camden, New Jersey.

The article features former prosecutors and several white collar trial attorneys, including Mr. Schneider, discussing what led to Mercer County Superior Court Judge Peter Warshaw dismissing all racketeering charges against Norcross, citing “the state failed to allege a single crime” in the more than 100-page indictment.

Mr. Schneider commented on Mr. Platkin’s use of a speaking indictment as “a publicity move” that ultimately backfired. He also noted “the state is going to be at a disadvantage” when it comes to an appeal, as their strategy invited scrutiny and left little room for legal maneuvering. 

Speaking indictments typically are comprised of more allegations and facts then deemed necessary under the law.  Here speaking refers to a length, not method of conveyance.
